My issue I think is quite simle. We have employed a builder – he was given all plans and gave a fixed priced. We signed a contract, He is now claiming that he was not aware of the full extend of the roof works and after undertaking the works he has now charged an additional amount. This was not agreed before the work was undertaken and only after completion did he state the new price. The contract does allow for additional charges for any changes. He was given an additional plans of the proposed roof in access of a month before work was undertaken – there was not any fundamental changes to the plan and those made were to make his job easier! and he did not take this opportunity to requote. He argument is simply that he believes we mislead him. He is also suddenly calling himself a subcontractor but we have no main contractor removing all the HS signs. Also he keeps asking us to hire equipment for him – my thoughts are that surely if he has agreed to undertake the work he should be provide equipment to complete it. He is currently off site.
